1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Cathay Bank N.A. ("Cathay Bank," "we," "us," or "our") governing your access to and use of our website, mobile application, and banking services (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where appropriate, sending you an email notification. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction)
- Be a legal resident of the United States or a supported jurisdiction
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using financial services under applicable law
- Provide accurate, complete, and current information during registration
By using our Services, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to suspend or terminate your account if we discover that you do not meet these requirements.
3. Account Registration and Security
When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring that you log out of your account at the end of each session
We reserve the right to disable any user account at any time in our sole discretion, including if we determine that you have violated these Terms.
4. Services Description
Cathay Bank provides digital banking services, including but not limited to:
- Checking and savings accounts
- Credit and debit cards
- Personal and business loans
- Mortgages and home equity lines of credit
- Investment and retirement accounts
- Money transfers and wire services
- Mobile and online banking
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
Certain Services may be subject to additional terms and conditions, which will be presented to you at the time you elect to use those Services.
5. Fees and Charges
We disclose all applicable fees and charges associated with our Services in our Fee Schedule, which is incorporated by reference into these Terms. By using our Services, you agree to pay all fees and charges applicable to your account and transactions.
Key fee policies:
- Fees are subject to change with 30 days' advance notice
- Overdraft fees may apply to checking accounts
- Wire transfer fees vary by destination and currency
- Foreign transaction fees may apply to international purchases
- Late payment fees apply to loans and credit cards
You authorize us to deduct applicable fees directly from your account. If your account has insufficient funds to cover fees, we may charge the fees to another linked account or suspend Services until payment is received.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Cathay Bank and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, data, or goodwill
- Service interruptions or downtime
- Unauthorized access to or alteration of your data
- Errors, mistakes, or inaccuracies in the Services
- Personal injury or property damage
Our total liability to you for all claims arising from or relating to these Terms or your use of the Services shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $500.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
7. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiations between the parties.
If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
The arbitration shall be conducted in New York, New York, unless otherwise agreed by the parties. The arbitrator's decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending the resolution of the arbitration.
8. Termination
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Fraudulent or illegal activity
- Non-payment of fees or charges
- Extended period of inactivity
- Regulatory requirements or legal obligations
Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
You may close your account at any time by contacting customer support or using the account closure feature in our mobile application.
9. Intellectual Property
The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by Cathay Bank, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. You may not:
- Reproduce, distribute, modify, or create derivative works of any content
- Use any content for commercial purposes without our express written consent
- Remove any copyright, trademark, or other proprietary notices
- Attempt to decompile, reverse engineer, or disassemble any software
- Use automated systems to access or scrape the Services
